MARLIN follows the best practices in the management of the shipping and export processes, namely as per INCOTERMS – International Commerce Terms.
It is up to the Purchaser/Customer to decide what level of services he intends to hire from MARLIN.
The figure below illustrates the different types of services available and intends also to inform the Purchaser of the responsibilities inherent to them.
Although we may have assisted in preparation of quantities for material to be shipped, all quantities must be verified by you or your representative in local, as we will not be held responsible for discrepancies.
Industry standard typically recommends ordering at least ten to fifteen percent (10-15%) overage, sometimes more, depending on the product type, patterning, etc., to account for cuts and other waste.
Product availability dates provided are estimates only and do not represent fixed or guaranteed delivery dates. Any additions or changes to the order could delay the delivery date and may result in dye lot variation.
Where MARLIN, Inc. collects tax where required by law, purchaser must provide MARLIN, Inc. with valid, properly completed exemption certificate for any tax from which Purchaser claims an exemption.
Whenever the Purchasers request that order has to be shipped to a country where MARLIN is not required by law to collect tax, Purchaser may be subject to additional tax and/or duties. It is the sole responsibility of the Purchaser to determine and remit these taxes or other charges where required.
Immediately upon delivery, please review the shipment for accuracy of materials ordered, including quantity, quality, and color, and for any shipping damage. Any visible shipping damage or shortage present upon delivery must be noted by purchaser or its agent on the freight carrier bill of lading at the time of delivery. All claims for freight damage or shortage must be reported in writing to MARLIN, Inc. and any delivery carrier within 24 hours of receipt of material. After 24 hours, MARLIN will not assume any responsibility for shipping damage or shortage. Any damage that is apparent upon delivery must be noted on the freight carrier delivery receipt. MARLIN, Inc. assumes no liability for direct, indirect, special or consequential damages, lost working time, or any expenses that relate directly or indirectly to variations in delivery dates and times or in the event of a delivery being delayed, postponed or incorrect.
Returns of stocked items are accepted within 14 business days after receipt of goods. Purchaser is responsible for the return freight fee to MARLIN Distribution Center. Returns must be in original condition to qualify. No refund will be given for product returned in non-salvable, damaged condition. Product must be received and inspected by MARLIN prior to issuing refund. Refunds will be issued within 14 business days after MARLIN’s Distribution Center receives the material.
Stock orders (prior to shipment to customer): Shipment of merchandise must be coordinated within 30 days of the initial order date, except where shipment cannot be made due to lack of inventory. If purchaser is not responsive and stops all communication with our concierge service on logistics and merchandise has not shipped within 30 days of the initial order date, order is subject to cancellation and a 25% forfeiture fee. Pre-arranged storage requires Purchaser to communicate with our concierge service to obtain approval of MARLIN, Inc. and is subject to warehouse storage fees.
MARLIN, Inc. does not accept responsibility or liability for installation, sealing, or refinishing of any product. Products should be inspected prior to installation and any defects must be reported at that time. Installation constitutes acceptance of the product. No adjustment can be made once material has been installed.
Product damage caused by improper installation methods, installing in unsuitable environments, other misuse, abuse, accident, or improper maintenance is not covered by MARLIN. With respect to stone, variations in color, shade, flow, grain, tonality, crazing, veining, and texture are inherent characteristics thereof and are not defects. Variations in facial dimensions and thickness will be allowed as per industry standards. MARLIN is not responsible for crazing, scratching or wear due to: improper installation-including improper alteration of the surface with sealers or grout, falling objects, abuse, misuse, exposure to extreme temperatures, using improper chemicals or compounds, non-foot traffic wear or other similar incidents.
All material is purchased with 100% due upon placement of order. Please inquire with our concierge service for specific requirements of your order. All orders must have full 100% payment prior to shipment of product. We accept cash, check and credit card (Visa, MasterCard, American Express). Completion of order is subject to credit application and approval.
There may be errors in the prices, descriptions or images of certain merchandise, and we must reserve the right to restrict orders of those items.
